APRA AMCOS advice for music customers wishing to stream concerts online

If you want to live stream performances of our music online, you may require a licence from us

APRA AMCOS will review each request on its individual circumstances as some industry-specific schemes may already cover streaming and we do not necessarily control all the relevant rights that your business may require.

IMPORTANT:

  • APRA AMCOS’ live stream licence only applies to live streams delivered to users within Australia and New Zealand
  • APRA AMCOS’ live stream licence does not cover live streaming of sound recordings
  • APRA AMCOS’ live stream licence does not cover the right to reproduce any musical works by way of synchronisation with any audio-visual material (also called sync rights)

Streaming music concerts and general performances

Facebook/Instagram/YouTube/TikTok

APRA AMCOS has licences in place for the communication of our music on the live streaming platforms Facebook, Instagram, YouTube and TikTok. These licences allow you to live stream performances of our music to users on those platforms. Of course, you will still need to ensure your activity complies with the platform’s terms and conditions, as your live stream is subject to the platform’s take down rules.

The streaming of pre-recorded or saved audio-visual recordings of our music on these platforms may require other, additional licences, from the owners of the copyright in both the musical work and the sound recording (such as a synchronisation licence). APRA AMCOS can assist you to find the relevant copyright holders.

Own platform/platforms not licensed by APRA AMCOS

Live Stream and Catch Up

For events live streamed on your own website, or a website or platform that is not otherwise licensed by APRA AMCOS, the licence fee will be 10% of all revenue generated from your live streamed event (subject to a minimum fee of $75 + GST per event). If the event is free, the licence fee will be 10% of expenditure on musical performers (subject to a minimum fee of $75 + GST per event).

This licence allows you to live stream APRA AMCOS’ musical works in your live stream, as well as making a recording of your live streamed event available for users on-demand for up to 7 days after the initial live stream of the event (‘Catch up’). We note that there may be other necessary clearances (such as synchronisation rights) from copyright holders that you will need to obtain.

On Demand Streaming

If you are making recordings of concerts or events available on-demand (whether on a subscription, pay per view or free basis) for longer than 7 days, the licence fee will be 12% of all revenue generated from your event and may be subject to a minimum fee.

This licence allows for the communication and reproduction of APRA AMCOS’ musical works in films of concerts and events made available on an on-demand basis. We note that there may be other necessary clearances (such as synchronisation rights) from copyright holders that you will need to obtain.
